Confused jury prompts Wyeth appeal

Was the jury confused? Apparently so. When a Nevada jury decided in favor of three women who claimed that the company's hormone replacement drugs caused their breast cancer, some jurors thought the $134.5 million awarded included punitive damages. It didn't.

The judge sent the jury back to the drawing board. Compensatory damages: $35 million. After the subsequent punitive phase, the jury tacked on another $99 in punitive damages. No harm, no foul? Not so fast. Wyeth says the confusion strengthens its inevitable appeal.
